1. Introduction & Acceptance

These Terms & Conditions (“Terms”) govern your use of the website etnaplants.ie, your purchase of goods, and your relationship with Etna Plants Ltd. By using our site, placing an order, or interacting with us, you agree to these Terms. If you do not agree, do not use our services.

2. Definitions

• “Buyer / you / your”: visitor or customer placing orders

• “We / us / our / Etna Plants Ltd”: the seller

• “Goods / Products / Plants”: the items sold

• “Services”: click & collect, delivery, consultation, etc.

• “Order”: your request to purchase from us

• “Contract”: binding agreement between us once order is accepted

3. Ordering & Contract Formation

• You place an order through our website or in person (click & collect).

• After placing an order, you will receive an order confirmation email.

• We reserve the right to accept or reject an order (e.g. stock unavailability, pricing error)

• The contract is formed when we send you a dispatch confirmation or collection notice.

4. Price & Payment

• Prices are shown in EUR and include VAT (unless otherwise indicated).

• Payment must be made by approved methods (credit/debit card, PayPal, or other processors).

• We do not store full card details; payments are processed through secure third-party gateways.

5. Delivery & Click & Collect

• Delivery is available within Ireland (or other regions if specified).

• Delivery times are estimates; delays may occur.

• Risk of loss or damage passes to you at delivery (or collection).

• For click & collect, collection must be within stated time — if you fail to collect, we may cancel and refund (minus costs).

6. Returns, Cancellations & Refunds

• You have the right to cancel your order within 14 days (for non-perishable goods) after delivery (except for goods that are made to your specification or perishable plants).

• To cancel, notify us in writing (email) and return goods in original condition (where possible).

• We may deduct for diminished value if goods are not returned in their original state.

• Refunds will be processed within 14 days after receiving the returned goods (or proof of return).

• Important: Live plants and perishable items may have reduced cancellation rights.

• For faulty or damaged goods, contact us immediately. We will repair, replace or refund at our discretion.

7. Use of the Website & Intellectual Property

• All content (images, designs, logos, text) on the site is our intellectual property or used under license.

• You may not reproduce, distribute, or modify content without our permission.

• You agree not to use the site in a way that causes harm, interference, or breach.

8. Limitation of Liability

• To the maximum extent permitted by law, we exclude liability for loss or damage arising from your use of the site or goods, except in cases of gross negligence or willful misconduct.

• Our liability for direct damage is capped to the price you paid for goods.

• We are not liable for indirect, incidental, consequential, or punitive damages.

9. Force Majeure

We are not liable for delays or failures to perform due to causes beyond our reasonable control (e.g. natural disasters, strike, flood, supply chain disruption).

10. Governing Law & Dispute Resolution

• These Terms and any disputes shall be governed by the laws of Ireland.

• You agree to submit to the exclusive jurisdiction of the courts of Ireland.

11. Severability & Entire Agreement

• If any part of these Terms is found invalid or unenforceable, that part may be severed without affecting the remainder.

• These Terms, together with our Privacy Policy and Cookie Policy, form the complete agreement between you and us.
